Welcome to Photo A Day (“Photo A Day”, “we” “us” or “our”) respects the privacy of our
users (“user” or “you”). This Privacy Policy explains how we collect, use, disclose and
safegaurd your information when you use our mobile application. (the “Application”).
The Service was built with the sole purpose of uploading and sharing photos, with the primary
purpose of uploading a single photo per day using our content-sharing platform.
The terms used in this Privacy Policy have the same meanings as in our Terms of Use, which is accessible at terms of use unless otherwise defined in this Privacy Policy.
Please read this Privacy Policy carefully. If you do not agree with the terms of this Privacy Policy, please do not use the Service.
INFORMATION COLLECTION AND USE
Information you provide us directly:
For a better experience, while using our Service, I may require you to provide us with certain personally identifiable information. The information that I request is retained on your device and is not collected by me in any way
- Your username, password and e-mail address when you register with Photo A Day.
- Profile information that you provide for your user profile (e.g. Full name (first and last name), profile picture, gender and your biography). This information is to improve your own profile, and allows us to help you or others to be “found” on in the application.
- User content (eg. photos and location) that you post using the Service.
- Communication between you and Photo A Day. We make use of account verification, password reset) We may also use this for changes/updates of the Application. Note that you may not opt out of Service-related emails.
Inviting your friends to Photo A Day:
- Note about “Invite” feature: If you choose to invite someone to the use the Service through our “Invite” feature, you may select a person from your contact list on your device and send an email from your personal account. You understand and agree that you are responsible for any
Device Identifiers:
- A device identifier may deliver to us or to a third party partner about how you browse and use the Application and may help us or others provide reports or personalised content.
Log Data
- I want to inform you that whenever you use my Service, in a case of an error in the app I collect data and information (through third party products) on your phone called Log Data. This Log Data may include information such as your device Internet Protocol (“IP”) address, device name, operating system version, the configuration of the app when utilizing my Service, the time and date of your use of the Service, and other statistics.
Cookies
- Cookies are files with small amount of data that is commonly used an anonymous unique identifier. These are sent to your browser from the website that you visit and are stored on your device internal memory.
- This Service does not use these “cookies” explicitly. However, the app may use third party code and libraries that use “cookies” to collection information and to improve their services. You have the option to either accept or refuse these cookies and know when a cookie is being sent to your device. If you choose to refuse our cookies, you may not be able to use some portions of this Service.
Metadata:
- Metadata is usually technical data that is associated with User Content. For example, Metadata can describe how, when and by whom a piece of User Content was collected and how that content is formatted.
- Users can add or may have Metadata added to their User Content including geotag (e.g. to mark your location to a photo). If you geotag your photo or tag your photo using other’s APIs then, your latitude and longitude will be stored with the photo (e.g. with the map feed feature and viewing a photo’s location).
HOW WE USE YOUR INFORMATION
Metadata:
- Help you effectively access your information after you log in
- Remember information so you will not have to re-enter it during your use of the Service or the next time you use the Service.
- Provide, improve, test and monitor the effectiveness of our Service
- Develop and test new features and products
- Monitor metrics such as total number of users, patterns and demographics
- Diagnose or fix technology problems
- Automatically update Photo A Day on your device
SHARING OF YOUR INFORMATION
We will not rent or sell your information to anyone without your consent, except as noted in this Policy.
Parties with whom we may share your information:
- We may share your information with third-party organisations that help us provide the Service to you. Our Service Providers will be given access to your information as is reasonably necessary to provide the functionality under reasonable confidentiality terms.
- We may remove parts of data that can identify you and share anonymised data with other parties. We may also combine your information with other information in a way that is no longer associated with you and share the aggregated information.

Parties with whom you may choose to share your User Content:
- Any information or content that you voluntarily disclose for posting to the Service, such as User Content, become available to the public. Once you have shared User Content, that User Content may be seen and used (e.g. downloaded) by others.
- Any User Content that you share is searchable and accessible by other Users.
- If you remove information that you posted using the Application, copies may remain viewable in cached and archived applications or if other Users or third parties using the Photo A Day application have copied or saved that information.
What happens in the event of a change of control:
- If we sell or otherwise transfer part or the whole of Photo A Day or our assets to another organisation (e.g. in the course of a transaction like merger, acquisition, bankruptcy, dissolution, liquidation) your information such as name and email address, User Content and any other Information collected through the Application may be among the items sold or transferred. You will continue to own your User Content. The buyer or transferee will have to honor the commitments we made in this Privacy Policy.
Responding to legal requests and preventing harm:
- We may access, preserve and share your information in response to a legal request (like a search warrant, court order or subpoena) if we have a good faith belief that the law requires us to do so. This may include responding to legal requests from jurisdictions outside of South Africa where we have a good faith belief that the response is required by law in that jurisdiction, affects users in that jurisdiction, and is consistent with internationally recognized standards. We may also access, preserve and share information when we have a good faith belief it is necessary to: detect, prevent and address fraud and other illegal activity; to protect ourselves, you and others, including as part of investigations; and to prevent death or imminent bodily harm. Information we receive about you may be accessed, processed and retained for an extended period of time when it is the subject of a legal request or obligation, governmental investigation, or investigations concerning possible violations of our terms or policies, or otherwise to prevent harm.
Service Providers
I may employ third-party companies and individuals due to the following reasons:
- To facilitate our Service;
- To provide the Service on our behalf;
- To perform Service-related services; or
- To assist us in analyzing how our Service is used.
I want to inform users of this Service that these third parties have access to your Personal Information. The reason is to perform the tasks assigned to them on our behalf. However, they are obligated not to disclose or use the information for any other purpose.
HOW DO WE STORE YOUR INFORMATION
- Your information collected through the Service may be stored and processed in South Africa or any other country in which Photo A Day, it’s Affiliates or Service Providers maintain facilities.
- Photo A Day, its Affiliates, or Service Providers may transfer information that we collect about you, including personal information across borders and from your country or jurisdiction to other countries or jurisdictions around the world. If you are located in the European Union or other regions with laws governing data collection and use that may differ from South African law, please note that we may transfer information, including personal information, to a country and jurisdiction that does not have the same data protection laws as your jurisdiction.
- By registering for and using the Service you consent to the transfer of information to the U.S. or to any other country in which Photo A Day, its Affiliates or Service Providers maintain facilities and the use and disclosure of information about you as described in this Privacy Policy.
- We use commercially reasonable safeguards to help keep the information collected through the Service secure and take reasonable steps (such as requesting a unique password) to verify your identity before granting you access to your account. However, Photo A Day cannot ensure the security of any information you transmit to Photo A Day or guarantee that information on the Service may not be accessed, disclosed, altered, or destroyed.
- Please do your part to help us. You are responsible for maintaining the secrecy of your unique password and account information, and for controlling access to emails between you and Photo A Day, at all times. Your privacy settings may also be affected by changes the social media services you connect to Photo A Day make to their services. We are not responsible for the functionality, privacy, or security measures of any other organization.
YOUR CHOICES ABOUT YOUR INFORMATION
- Update your account at any time by logging in and changing your profile settings.
CHILDREN’S PRIVACY
Photo A Day does not knowingly collect or solicit any information from anyone under the age of 13 or knowingly allow such persons to register for the Service. The Service and its content are not directed at children under the age of 13. In the event that we learn that we have collected personal information from a child under age 13 without parental consent, we will delete that information as quickly as possible. If you believe that we might have any information from or about a child under 13, please contact us.
OTHER WEB SITES AND SERVICES
We are not responsible for the practices employed by any websites or services linked to or from our Service, including the information or content contained within them. Please remember that when you use a link to go from our Service to another website or service, our Privacy Policy does not apply to those third-party websites or services. Your browsing and interaction on any third-party website or service, including those that have a link on our website, are subject to that third party's own rules and policies. In addition, you agree that we are not responsible and do not have control over any third-parties that you authorize to access your User Content. If you are using a third-party website or service and you allow them to access your User Content you do so at your own risk.

In the event of the death of an Photo A Day User, please contact us. We will usually conduct our communication via email; should we require any other information, we will contact you at the email address you have provided in your request.
SECURITY
I value your trust in providing us your Personal Information, thus we are striving to use commercially acceptable means of protecting it. But remember that no method of transmission over the internet, or method of electronic storage is 100% secure and reliable, and I cannot guarantee its absolute security.

We reserve the right to make changes to this Privacy Policy at any time and for any reason. We will alert you about any changes by updating the “Last updated” date of this Privacy Policy.

You will be deemed to have been made aware of, will be subject to, and will be deemed to have accepted the changes in any revised Privacy Policy by your continued use of the Service after the date such revised Privacy Policy is posted.
